Terms of Use

This is a legal agreement (hereafter "Agreement") between you as a registered user (hereafter "Registrant") of the online service chessopeningsdatabase.net (hereafter "Service") and Active Data Online Pty Ltd ABN 83 095 152 453 (hereafter "Active Data Online").

Active Data Online grants to the Registrant a non-exclusive, non-transferable licence to use the Service, subject to the following terms and conditions.

The Registrant agrees not to open and use multiple user accounts. The Registrant agrees not to use a user name that may be offensive to others. The Registrant agrees to refrain from posting material that is illegal, in breach of copyright, defamatory, hateful, obscene, nonsense, spam, or the like. The Registrant agrees not to disrupt the Service, deny others from the Service, or undermine the Service.

Non compliance may result in the Registrant being suspended or blocked from the Service.

The Service may change from time to time at the discretion of Active Data Online but will remain in essence an online chess openings database and a chess games server.

Due to the possibility of unforseen network or system problems, the availability of the Service cannot be guaranteed.

To the maximum extent permitted by applicable law, the Service is provided "as is" and without warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability or fitness for a particular purpose.

To the maximum extent permitted by applicable law, in no event shall Active Data Online, or its shareholders or directors, be liable for any special, incidental, indirect, consequential or punitive damages whatsoever arising out of or in any way related to the use of or the inability to use the Service.

The Service may cease at the discretion of Active Data Online, if it is found to be not commercially viable.

This Agreement shall be construed and controlled by the laws of the Commonwealth of Australia. Exclusive jurisdiction and venue for all matters relating to this Agreement shall be in courts located in the State of Victoria. The Registrant consents to such jurisdiction and venue.
